TERMS AND CONDITIONS OF SALE

ARTICLE 1 – ACCEPTANCE
The customer acknowledges, at the time of ordering, having read the special terms and conditions of sale set out below and declares that they accept them without reservation.
These general terms and conditions govern the contractual relationship between HÉLIPRO and its customer.
They apply in particular to ordering, payment, delivery, and the handling of any returns for products ordered by customers. These general terms apply to all new goods and services sold on the website shophelipro.re and take effect upon validation of the order form, which constitutes a signature and/or electronic signature.
ARTICLE 2 – ORDER
Orders can be placed in-store or on the website: helipro.re.
HÉLIPRO reserves the right to cancel any order from a customer with whom there is a dispute related to the payment of a previous order or repeated returns/withdrawals.
All information provided by the buyer at the time of ordering is binding on the buyer.
HÉLIPRO cannot be held liable for any consequences arising from errors in the recipient’s or payer’s details indicated by the customer.
The consumer is informed that, regarding the collection of their phone number, they may register on the BLOCTEL opt‑out list (http://www.bloctel.gouv.fr/).
ARTICLE 3 – PRICE, PAYMENT AND INVOICES
General: Prices are payable in euros at the time of ordering. An order validated by the customer is considered effective when the payment centers have given their approval. In the event of refusal, the order will be cancelled. On the website, your invoice and the terms and conditions can be downloaded in PDF from your customer account or are available in-store.
Online payment:
- PayPal: you will be redirected to PayPal’s secure website.
- Bank transfer: items are reserved and prepared only upon receipt of the transfer.
- Bank cheque (Réunion island only): items are reserved and prepared only upon cheque clearance. Send your payment to: HÉLIPRO, 28 Av. du Grand Piton – ZI de Cambaie, 97460 SAINT‑PAUL.
In‑store payment: Bank card: immediate payment – Deferred card payment: 4 instalments – Cash.
ARTICLE 4 – DELIVERY
Delivery time depends on the actual availability of products when shown “in stock”.
Any delay shall not entitle the buyer to claim damages from HÉLIPRO. Goods always travel at the seller’s risk.
The customer must carefully check parcels and report any damage to the carrier. If a parcel is delivered in poor condition or shows signs of opening, the customer must refuse it and note “parcel refused, damaged” on the delivery slip; failing this, HÉLIPRO declines any liability.
In case of non‑collection, re‑delivery costs shall be borne by the customer.
ARTICLE 5 – OUR GUARANTEES
Secure payment:
Your payment security is our priority. All transactions on HÉLIPRO are processed securely. All personal data transmitted to our security server is protected before being sent over the internet.
Damaged item or non‑conformity with the order:
We take great care in selecting and packing your products, but errors or incidents may occur. In such cases, you have 10 days to notify us via the Contact form. If conformity was checked at delivery and confirmed by the carrier, the period is 3 days.
Right of withdrawal:
Under Article L.221‑21 of the French Consumer Code, in distance selling the consumer customer has a 14‑day withdrawal period from receipt of the products, except for the exclusions set out in Article L.221‑28:
- Goods made to the customer’s specifications or clearly personalized (e.g. model kits assembled by HÉLIPRO at the customer’s request – airplanes, helicopters, drones, motor gliders, etc.).
- Goods unsealed after delivery that cannot be returned for reasons of hygiene or health protection (e.g. helmets).
- Batteries and accumulators: for safety reasons, no return or refund is possible.
- Orders paid online and collected directly in‑store are not eligible for the right of withdrawal.
- The right of withdrawal does not apply to purchases made by professionals.
Starting point of the 14‑day period
The 14‑day period starts from the customer’s effective receipt of the product.
For delivery to a pick‑up point or in‑store collection, the period starts on the date the parcel is made available, not on the day it is collected by the customer.
How to exercise the right of withdrawal
Within the period indicated above, the customer must:
- Open their Customer Account, select the order containing the item, tick it, state the reason in the box under RETURN MERCHANDISE, then click SEND A PRODUCT BACK.
- Wait for validation from our After‑Sales Service (SAV), who will inform their decision and, if accepted, issue a return number. You can also track the return status in your account under PRODUCT RETURNS.
- Return the product with the return number to the address indicated on the RETURN MERCHANDISE form.
Return conditions and product state
Pursuant to Article L.221‑23 of the French Consumer Code (depreciation), the customer is liable for any depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics or proper functioning of the goods.
The product must therefore be returned in perfect condition, complete (manual, accessories, any free gifts) and in its original packaging, intact (no tears).
Any product returned damaged, incomplete, showing signs of use, or with damaged/missing original packaging may:
- be refused, or
- be subject to a deduction applied to the refund, corresponding to the loss of value (minimum 15% and up to 30% depending on the condition).
Refund / Credit note / Exchange
Upon receipt and after verification of the product’s integrity by our SAV, HÉLIPRO will proceed with:
- a refund,
- or issuance of a credit note,
- or an exchange, according to the customer’s choice.
The refund will be made within a maximum of 14 days following receipt of the returned products, using the same means of payment as used for the order.
ARTICLE 6 – WARRANTY AND AFTER‑SALES SERVICE
All our products benefit from the legal warranty. Any after‑sales return must be notified to HÉLIPRO in advance and accepted by our services. To properly handle your request, a copy of the invoice must be enclosed with the return.
Return shipping costs are borne by the customer for out‑of‑warranty service.
Reshipment costs after repair or exchange are borne by the customer for out‑of‑warranty service.
Some manufacturers do not authorize third‑party after‑sales intervention; the device must be returned to the factory for checks or repairs. Example: purchasing a DJI device implies acceptance of that manufacturer’s warranty terms; returns are factory‑bound for service. Any immobilization of more than 7 days extends the duration of the legal warranty accordingly.
ARTICLE 7 – LIABILITY
Given the specific nature of model aircraft activities, HÉLIPRO cannot be held liable for damages of any kind, whether material, immaterial, bodily, or for piloting errors that may occur.
ARTICLE 8 – LIMITATION OF LIABILITY: ACCUMULATORS / BATTERIES
Limitation of liability related to LiPo/LiFe/NiMH batteries, etc. All our batteries are checked at the time of sale.
HÉLIPRO cannot be held liable for consequences arising from the use of Li‑ion, Li‑Polymer or other batteries, which require strict usage guidelines to avoid damage. HÉLIPRO cannot guarantee that the user will respect current intensity, charge/discharge capacities, cycles, storage requirements, precautions of use, or any modifications to cables, plugs or soldering (e.g. damaged, swollen, burst batteries after a crash, stripped cables, etc.).
In aeromodelling, batteries are considered hazardous and experimental. By purchasing these products, you automatically agree to the conditions stated above. The user accepts this limitation of liability clause and is fully responsible for the consequences of use, agreeing not to hold the seller liable for any accident, injury, death or property damage.
HÉLIPRO is therefore released from any liability regarding the use of lithium‑polymer batteries, including partial or total destruction of a model or the battery, environmental or third‑party damage, and premature ageing of electronic or electrical components. This limitation applies whether the battery was sold with a model or separately.
ARTICLE 9 – APPLICABLE LAW – JURISDICTION
In case of dispute, the customer must first contact the store by phone: +262 262 35 27 87 or by registered letter with acknowledgment of receipt to: HELIPRO, 28 Av du Grand Piton – ZI de Cambaie – 97460 SAINT‑PAUL (Réunion island).
For complaints already submitted in writing to HELIPRO customer service, the consumer may refer free of charge to our mediation service: AME CONSO, 197 Boulevard Saint‑Germain, 75007 PARIS.
The solution proposed by the mediator is not binding on the parties, who may end the mediation process at any time. Failing agreement, if the customer is a consumer, the competent court shall be designated under ordinary rules of law.
ARTICLE 10 – DATA PROTECTION RIGHTS
Right of access, amendment, rectification and erasure:
